These Terms and Conditions (“Terms”) govern your use of the Orchestrated Quiz Night platform (“OQN”, “we”, “us”, “our”), accessible at [platform URL].

1. About These Terms

These Terms govern your use of OQN, accessible at [platform URL]. By creating an account, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not use the platform.

We reserve the right to update these Terms at any time. Material changes will be communicated via email and in-app notification, with at least 14 days’ notice. Continued use after that period constitutes acceptance.

2. Eligibility and Registration

2.1 Age Requirement

You must be 18 years of age or older to register. By registering, you confirm that you meet this requirement.

2.2 Account Accuracy

You agree to provide accurate, current, and complete information during registration and to keep your details up to date. You are responsible for all activity that occurs under your account.

2.3 One Account Per User

You may only hold one account. Creating multiple accounts to gain token bonuses or circumvent restrictions may result in permanent suspension and forfeiture of all token balances.

2.4 Geographic Scope

The platform is primarily intended for use in the United Kingdom. We make no warranty that the platform is appropriate for use in other jurisdictions.

3. User-Generated Content

3.1 Ownership

You retain copyright and ownership of all original questions and bundles you upload. By uploading, you grant OQN a perpetual, worldwide, royalty-free, non-exclusive licence to store, display, and distribute Your Content within the platform.

3.2 Content Licence to Purchasers

Purchasers are granted a limited, non-transferable licence to use questions in live quiz sessions. They may not re-sell, republish, or redistribute your content.

3.3 Content Standards

All content you upload must:

  • Be your own original work or content you have the right to share
  • Not infringe any copyright, trademark, or other intellectual property rights
  • Not contain offensive, discriminatory, hateful, or illegal material
  • Be factually accurate to the best of your knowledge
  • Be appropriately categorised, tagged, and described

3.4 Content Moderation

OQN reserves the right to remove content that violates these Terms. Royalties earned in the 30 days prior to removal for a verified violation may be reversed.

3.5 Intellectual Property Disputes

If you believe content infringes your IP rights, contact us at [contact email]. We will act on valid takedown requests in accordance with applicable UK copyright law.

4. Token Economy

4.1 Nature of Tokens

OQN Tokens are a virtual in-platform currency with no real-world monetary value unless a cash payout programme is explicitly enabled (see §5). Tokens are not a financial product and do not constitute e-money.

4.2 Earning Tokens

Tokens may be earned by:

  • Creating a new account (onboarding bonus)
  • Uploading questions accepted into the marketplace
  • Rating and validating content, within daily limits
  • Contributing multiple-choice wrong answers to eligible questions
  • Receiving royalties when bundles containing your questions are purchased

4.3 Spending Tokens

Tokens may be spent to purchase and download question bundles or individual questions (where enabled).

4.4 Token Transactions

All token transactions are final and non-refundable, except where a platform error caused an incorrect deduction, or where purchased content is removed for a Terms violation. OQN reserves the right to adjust token balances to correct errors or address abuse.

4.5 Changes to Token Economy

OQN reserves the right to change token reward rates, costs, royalty splits, and caps at any time. We will provide 14 days’ notice of material changes. The platform may introduce dynamic pricing in future; this will be clearly communicated.

4.6 Promotional Tokens

Promotional bonuses do not set a precedent or create any ongoing entitlement and may be withdrawn at any time.

4.7 Token Expiry

Tokens in inactive accounts may expire. We will notify you by email at least 30 days before any expiry is applied.

4.8 Future Paid Tokens

If we introduce purchasable Tokens, we will publish clear pricing, provide UK-compliant refund policies, disclose tax implications, and apply for any required regulatory permissions.

5. Author Cash Payouts

5.1 Eligibility

Cash payouts are an opt-in programme. You must provide valid UK bank details or an approved payment method.

5.2 Minimum Threshold

The minimum payout is £10. Balances below this accumulate until the threshold is met.

5.3 Conversion Rate

The current token-to-GBP rate is published on the platform. The rate at the time of your payout request applies.

5.4 Payment Processing

Payouts are processed via a third-party provider. OQN is not liable for delays or failures caused by third-party processors.

5.5 Tax Responsibilities

It is your sole responsibility to declare OQN earnings to HMRC. OQN does not deduct tax at source.

5.6 Forfeiture on Termination

If your account is terminated for fraudulent activity or manipulation of the token economy, pending payout balances may be withheld.

6. Service Availability

6.1 No Guarantee of Availability

OQN is provided “as is” and “as available”. We do not guarantee uninterrupted or error-free access.

6.2 Limitation of Liability for Downtime

To the fullest extent permitted by UK law, OQN accepts no liability for:

  • Lost tokens, scores, or session data caused by outages
  • Failure of the quiz presentation tool during a live event
  • Business losses or costs arising from unavailability
  • Data loss caused by technical failure, except where caused by our gross negligence

6.3 Offline Failsafe

All purchased bundles can be downloaded whilst your account is in good standing. We strongly recommend downloading bundles prior to a live quiz event.

6.4 Planned Maintenance

We will endeavour to give advance notice of maintenance causing more than 60 minutes of unavailability.

7. Quiz Session Data

7.1 Data Collected

When you run a quiz session, we collect: team names, scores, session date/duration, and bundles used.

7.2 Host Control

Session data is private by default and belongs to you. OQN will not publish individual team names or scores without your permission.

7.3 Platform Use

OQN may use aggregated, anonymised session data for bundle difficulty analysis and product improvement. We will not share session-specific data with third parties.

8. Data Protection and Privacy

8.1 Privacy Policy

8.2 Data We Collect

We collect: account information, activity data (questions, bundles, ratings, reputation events), and analytics data. Full details are in our Privacy Policy.

8.3 Lawful Basis

We process your data on the basis of: contract performance, legitimate interest (security, fraud prevention, analytics), and consent (marketing).

8.4 Data Retention

Personal identifiers are removed within 30 days of account deletion. Transaction records are retained for audit purposes in anonymised form as required by law.

8.5 Your Rights

Passwords are stored using bcrypt hashing. All data in transit is encrypted via HTTPS/TLS.

9. Communications and Marketing

9.1 Operational Emails

By registering, you consent to operational emails necessary for the functioning of your account (verification, password resets, policy changes, security alerts, payout notifications). You cannot opt out of these while your account is active.

9.2 Marketing Emails

We only send marketing communications if you have explicitly opted in. You may withdraw consent at any time via account settings or by unsubscribing from any marketing email.

10. Prohibited Conduct and Abuse Prevention

10.1 Prohibited Activities

You must not:

  • Create multiple accounts to obtain bonuses or circumvent restrictions
  • Submit plagiarised, duplicate, or AI-generated spam content
  • Manipulate ratings, validations, or votes through collusion or fake activity
  • Use bots or scripts to farm tokens
  • Attempt to reverse-engineer, scrape, or extract platform data
  • Harass or abuse other users
  • Attempt to defraud the token economy or payment systems

10.2 Enforcement

Consequences may include warning, suspension, permanent ban, token forfeiture, payout withholding, and reduction of reputation score (see §15.4). We will notify you where possible and provide an opportunity to appeal via [support email].

11. Liability and Disclaimers

11.1 Content Accuracy

OQN does not guarantee the factual accuracy of user-generated content. We recommend reviewing content before use in a live event.

11.2 Liability Cap

To the fullest extent permitted by UK law, OQN’s total liability shall not exceed the greater of: (a) the total tokens purchased with real money in the preceding 12 months, or (b) £50. Nothing limits liability for death or personal injury caused by negligence or fraud.

11.3 Online Safety

Reports of illegal or harmful content can be submitted via [report link / contact email]. We will review reports promptly and maintain an appeals process for content removal decisions.

12. Account Termination

12.1 By You

You may delete your account at any time. Token balances are forfeited on voluntary deletion. Pending cash payouts above the minimum threshold will be processed before deletion is finalised, if the account is in good standing.

12.2 By OQN

We may suspend or terminate your account for breaches of these Terms or fraudulent activity. We will provide notice where reasonably practicable.

12.3 Platform Closure

If OQN ceases trading, we will provide at least 30 days’ notice. Users with opted-in payout balances above the minimum threshold may request a payout during this period.

13. Dispute Resolution

13.1 Content Disputes

Disputes about content ownership or plagiarism should be raised at [moderation email]. OQN’s decision is final within the platform, without affecting any legal rights you may have.

13.2 Disputes with OQN

Contact us first at [support email]. We aim to resolve disputes informally within 14 working days. Either party may then pursue mediation or legal action under the laws of England and Wales.

13.3 Governing Law

These Terms are governed by the laws of England and Wales. Both parties submit to the exclusive jurisdiction of the courts of England and Wales.

14. General

14.1 Entire Agreement

These Terms and our Privacy Policy constitute the entire agreement between you and OQN and supersede all prior agreements.

14.2 Severability

If any provision is found invalid or unenforceable, the remaining provisions continue in full force.

14.3 No Waiver

Failure to enforce any provision shall not constitute a waiver of our right to enforce it in future.

14.4 Assignment

You may not assign your account or rights under these Terms. OQN may assign its rights in connection with a merger, acquisition, or sale of assets.

15. Reputation System New v1.1

15.1 What is the Reputation Score?

The OQN Reputation Score is a numeric measure of your standing as a contributor. It is distinct from your token balance and has no monetary value. It reflects the quality and trustworthiness of your contributions as assessed by the platform’s automated systems and, where applicable, by OQN staff.

15.2 How Reputation is Earned

Reputation points are awarded automatically when:

  • A question you submitted is accepted into the marketplace (community-validated or admin-approved)
  • A bundle you created is purchased by another user
  • The average rating across your published bundles improves

The specific point values for each event are published in the platform and may be adjusted with reasonable notice. Legitimately earned reputation will not be reduced except as described in §15.4.

15.3 Creating Content vs. Publishing to the Marketplace

We believe every user should have full creative freedom, regardless of their reputation score. The following principle applies throughout the platform:

You can always create bundles and Quiz Packs from your own content. Reputation gates apply only to publishing that content to the public marketplace, not to creating or using it privately.

15.4 Discretionary Reduction of Reputation Score

OQN reserves the right to reduce your reputation score at our discretion in response to a breach or suspected breach of these Terms. This includes but is not limited to:

  • Submission of plagiarised, inaccurate, or prohibited content
  • Manipulation of ratings, votes, or validation actions
  • Abuse of the trusted-contributor auto-approval pathway
  • Harassment or abuse directed at other users
  • Any conduct that, in OQN’s reasonable judgement, undermines the integrity of the platform or its community

Where a significant reduction is applied (more than 50 points in a single action), you will be notified by email with a brief explanation. You may appeal via [support email] within 14 days.

Your score is floored at zero and cannot be reduced below zero. A score reduction does not by itself constitute account termination, but a pattern of repeated reductions may result in further action under §12.

This system is designed to reduce administrative overhead by tying platform privileges to sustained positive behaviour — creating a self-regulating community where trusted contributors benefit from reduced friction.

15.5 No Guarantee of Threshold Permanence

Reputation thresholds and associated privileges may change at any time. We will provide reasonable notice of changes that would remove an existing privilege. Changes that grant new privileges may take effect immediately.
